By using the mobile application Spotter (the “App”), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the App, including, without limitation, users who are browsers, vendors, customers, merchants, and/ or contributors of content. The Terms of Service are set forth by the company Unusual Emporium Limited.

Please read these Terms of Service carefully before accessing or using our App. By accessing or using any part of the App, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the App or use any services.

By using Spotter, you confirm that you are at least the age of majority in your jurisdiction. If you are the parent or guardian of a minor, you agree to these Terms on their behalf and take full responsibility for their use of the Service.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature. A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.You understand that your content may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices.

Fair Use and Rate Limiting: We reserve the right to implement “Fair Use” limits on the frequency of scrapes and the number of requests per scrape to ensure service stability. Accounts found to be abusing the system or attempting to circumvent technical limitations may be suspended or terminated without refund.

Payments for Spotter are processed through third-party app stores (Apple App Store or Google Play Store). All billing inquiries, refunds, and subscription cancellations must be managed through your respective app store account. We do not directly store or process your credit card information. Prices for our products are subject to change without notice.

About Auto-Renewable Subscription:
(a) Payment: Payment will be charged to your Apple App Store or Google Play Store Account at confirmation of purchase.
(b) Auto-Renewal: Subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current period.
(c) Account Charged: Account will be charged for renewal within 24-hours prior to the end of the current period. The cost of the renewal will match the initial subscription price unless otherwise notified.
(d) Management: Subscriptions may be managed by the user and auto-renewal may be turned off by going to the user's Account Settings after purchase.
(e) Cancellation: You can cancel your subscription at any time through your Apple App Store or Google Play Store account settings. To avoid being charged for the next period, you must cancel at least 24 hours before the current subscription period ends.
(f) No Refunds: We do not offer refunds for any unused portion of the subscription period.
(g) Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

We are not responsible if information made available on the App is not accurate, complete or current. The material on this App is provided for general information only.

Third-Party Data Disclaimer: You acknowledge that the data retrieved by the Service is sourced from third-party websites. We do not guarantee the accuracy, integrity, or quality of such data. The Service may fail to retrieve data due to website changes, anti-bot protections, or network issues. We are not liable for any decisions made based on data retrieved through the Service. Any reliance on the material on this App is at your own risk.

The Service is a neutral tool designed to monitor web content. You are solely responsible for ensuring that your use of the Service to monitor or scrape any specific third-party website complies with that website’s Terms of Service, robots.txt files, and applicable local and international laws (including data privacy laws). Spotter does not verify the legality of the URLs provided by the user.

We may provide you with access to third-party tools (such as proxy services or rendering engines) over which we neither monitor nor have any control. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties.Certain content available via our Service may include materials from third-parties. Third-party links on this App may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of third-party materials.

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the App or its content: (a) for any unlawful purpose;
(b) to solicit others to perform or participate in any unlawful acts;
(c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate;
(f) to submit false or misleading information;
(g) to upload or transmit viruses or any other type of malicious code;
(h) to collect or track the personal information of others;
(i) to spider, crawl, or scrape the App’s own internal infrastructure, source code, or user data;
(j) to use the Service to harvest data in a manner that violates the terms of service of a target website or any applicable data privacy laws (such as GDPR or PDPO);
(k) for any obscene or immoral purpose; or
(l) to interfere with or circumvent the security features of the Service.

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

Service Breakage Disclaimer: The Service depends on the structure of third-party websites. You acknowledge that if a third-party website modifies its layout, security measures, or accessibility, the Service may cease to function for that specific URL. We are under no obligation to provide updates or fixes for specific third-party website changes. Furthermore, we do not warrant that the Service will be able to bypass the security measures or anti-bot protections (e.g., Cloudflare, DataDome) of any specific third-party website.

In no case shall Spotter, Unusual Emporium Limited, our directors, officers, or employees be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, or consequential damages of any kind, including, without limitation lost profits, lost revenue, or loss of data arising from your use of the service.

You agree to indemnify, defend and hold harmless Spotter and Unusual Emporium Limited harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service, your use of the Service to access third-party content, or your violation of any law or the rights of a third-party.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Hong Kong SAR, and all parties submit to the non-exclusive jurisdiction of the courts of Hong Kong.
